A Sicilian man has filed a lawsuit against a restaurant after featuring him in a promotional TikTok video without his consent. The case is a bit more complicated than it seems, because the said video was seen by the man’s wife and led to their marriage falling apart. The video was used as proof of his infidelity, so the man is now suing the restaurant for invasion of privacy.

It’s unclear if the scorned wife just stumbled upon the promotional TikTok video featuring her husband, or if someone else recognized him and just sent it to her, but the important thing is she saw her spouse with another woman, even though he had told her he was attending a business dinner with colleagues. Humiliated by his public infidelity, she decided to end the relationship and kick him out of the house.

When the 42-year-old man learned that his wife had discovered his affair by watching a promotional video for the restaurant, he decided to take legal action against the owners of the establishment, claiming that his rights to privacy had been violated. Codacons, an Italian consumer protection association representing the man in this legal battle, claims that the restaurant was clearly in the wrong.

“It is unacceptable for a restaurant to film its customers without clear consent and then broadcast the images, exposing people to unpredictable consequences,” Francesco Tanasi, a spokesperson for Codacons, said. “In some cases like this one, the publication of a video can have very serious effects on a person’s private and family life.”

Codacons is seeking damages for its client, but it is also considering filing a complaint with the Italian data protection authority. The lawsuit could have serious consequences regarding personal privacy and marketing.
